IS MY LEGAL INSURANCE VALID IN TURKEY? DOES IT COVER THE COSTS OF LEGAL PROCEEDINGS IN TURKEY?
The legal insurance you have taken out in your country of residence is generally also valid in Turkey. Depending on your policy, legal insurances usually cover the costs of legal steps to be taken for the compensation you claim abroad. We can find out for you whether your legal insurance is valid by contacting the relevant insurer.
WHICH LEGAL INSURANCE COMPANIES DO YOU WORK WITH?
We have worked with many legal insurers so far. In principle, legal insurers can recommend a lawyer to you, but they cannot force you to choose a particular lawyer. The insured person is free to choose who they want to represent them. If you provide us with information about your legal insurance, we can contact your insurer for you.
WHO CONTACTS THE LEGAL INSURANCE? WHO DOES THE CORRESPONDENCE WITH THE LEGAL INSURANCE COMPANY?
You can either contact your legal insurance company or we can contact your legal insurance company for you. If you contact the legal insurance company, you just need to get a Schadennummer for the case and report it to us. We can handle the rest of the correspondence. Alternatively, if you provide us with details of your insurance, we can follow up the matter on your behalf from the outset.
IF MY INSURANCE DOES NOT APPROVE THE CASE, WHO WILL COVER THE COSTS UP TO THAT POINT?
Your first consultation with us is free of charge (Erstberatung). If you inform us during this consultation that you have legal insurance, we will contact the relevant insurance company. Necessary correspondence will be made. You will not be charged a fee for this stage. All our work is free of charge until we receive confirmation that your legal insurance will cover the costs.
DOES YOUR OFFICE COVER CASES ALL OVER TURKEY?
Our office handles legal proceedings all over Turkey. There are no regional or city restrictions.
HOW CAN I AUTHORISE YOU?
In order to pursue legal proceedings in Turkey, you need to send us a power of attorney. It is a bit more difficult to obtain a power of attorney that is valid in Turkey than abroad (e.g. Germany). Powers of attorney that are not notarized or consular approved are not valid in Turkey.
HOW CAN I GET A POWER OF ATTORNEY?
Issuing a power of attorney in Turkey
Power of attorney can only be issued at a notary public in Turkey. Turkish citizens can obtain a power of attorney by presenting their identity card or blue card at the notary public.
Foreign citizens, on the other hand, must go to the notary public with their passports. At the notary, they will first have their passports translated into Turkish and a power of attorney will be issued in the presence of a sworn translator.

Issuing a power of attorney abroad
Turkish citizens residing abroad or blue card holders can have a power of attorney issued by Turkish Consulates abroad or by notaries abroad.
Foreign citizens, on the other hand, are obliged to have a power of attorney issued by notaries in their country. After the power of attorney prepared by our office in two languages (e.g. German-Turkish) is sent to our client, this document must first be signed at the notary public. The notary must approve both the document and the signature. Once the power of attorney has been issued by the notary public, the power of attorney must be apostilled by the competent authority (e.g. Amtsgericht/Landsgericht). The apostille process is carried out by the relevant state authority of each country. Powers of attorney that are not apostilled have no validity in Turkey and cannot be presented to a court or a relevant authority.

DO I NEED TO SEND YOU THE ORIGINAL POWER OF ATTORNEY?
After you have obtained the power of attorney from the relevant institution, we kindly ask you to send it to us via e-mail. In this way, if there is a deficiency in the document, we will be able to correct it before it reaches us.
Once we have confirmed validity of the document, we will ask you to send the original power of attorney to our address.
WHO TRANSLATES THE DOCUMENTS I WILL SEND INTO TURKISH? WHO PAYS FOR THE COSTS?
Documents to be submitted to Turkish Courts must be translated into Turkish. Translation services are provided by us. However, of course, if you submit notarized translated documents to us, these documents can be submitted to the court after they have been reviewed by us, if they meet the standards.
If you have legal insurance, the insurance company will also cover the translation costs.
DO I NEED TO COME TO TURKEY TO ATTEND THE HEARINGS?
You do not have to attend the hearings in person. Your lawyer will attend the hearings on your behalf.
DO I HAVE TO COME TO TURKEY FOR A MEDICAL EXAMINATION?
Our clients who claim compensation for injuries or medical procedures may need to come to Turkey for a one-off visit during the litigation phase. This is because the Forensic Medicine Institution examines the injured person. In some cases, this examination procedure can be bypassed by obtaining a doctor’s report from the institutions in the country where you are located, without an examination in Turkey. However, since the court will make the final decision, it is not possible to guarantee this.
The costs of medical examinations during the proceedings are generally covered by legal insurances, but this should be confirmed with the relevant insurances company.

CAN I CLAIM MY COMPENSATION IN TL OR IN EURO/DOLLAR?
Persons living abroad can claim compensation in the currency of the country in which they live, regardless of which country they are a citizen of. For example, a person living in Germany can claim material and moral damages in Euros in a lawsuit filed in Turkey. Please contact us for details.
